The aim of this essay is to discuss, drawing from a perspective considering both religious liberty as such and the foundations of freedom of belief, how judges decide in Brazil. I therefore present how religious liberty develops in German law along with brief reflections on conscientious objection in Brazil, in order to discuss the negative impacts of judicial activism in Brazil. The research was based on a phenomenological method, investigating the several layers underlying the investigated phenomena and the linguistic soil in which it is founded.
