Neurolaw and medical liability: how to reduce the impact of false memories in lawsuits?

Abstract

The aim of the article is to point out ways to face the legal problems generated by false memories in legal proceedings in which medical error is discussed, with a focus on testimonial and documentary evidence. A hypothetical-deductive methodology and bibliographic review were used in the areas of Cognitive Psychology, Legal Psychology, Medicine and Legal Epistemology. As a result, suggestions were identified with the potential to reduce the impact of false memories in litigation related to medical error, distributed in two thematic axes: effectiveness of the law procedure and medical law. Among the proposed measures are the shortening of the time between the date of the fact and its investigation and clarification through records in medical records and testimonial statements, the use of scientifically validated methods for hearing witnesses, the adoption of standardization mechanisms for filling out medical records and the implementation of an external medical record review audit. The study concluded that although the current state of knowledge makes it impossible to eliminate the interference of false memories in the evidential result and in the justification of the court decision, there are paths with potential to reduce its impact.
