Abstract

This article analyzes the situation of human and non-human traction vehicles as a portrait of the social vulnerability to which their drivers are inserted, resulting, above all, in findings of animal suffering and cruelty practiced against non-humans employed in these practices. In this sense, the author seeks to clarify what rights humans and non-humans have regarding the use of blood traction, as he calls this modality. Therefore, the research addresses some peculiarities about Argentine Penal Law n.º 14.346, specifically with regard to non-human animals as victims of the crime of mistreatment, in addition to contextualizing the circumstances involving human and non-human traction vehicles, such as social vulnerability, marginality, state inefficiency and even the protection of driving children and adolescents. The methodology chosen for this investigation is based on a bibliographic review, documental research and case presentation, as can be seen from the prohibitions of human and animal traction found in the cities of Paraná/AR and Quilmes/AR.
