IDENTIFICACIÓN DE BRECHAS Y DESAFÍOS EN LA (IN) DEFINICIÓN DE UN PROBLEMA LEGAL

Resumen

La contaminación marina por residuos plásticos es un problema ambiental de carácter transcontinental y difuso. A pesar de su escala global, todavía existen importantes vacíos y desafíos legales en la comprensión a gran escala de este fenómeno. El objetivo del artículo es discernir sobre dos lagunas identificadas: la ambigüedad de terminologías y la ausencia de regulación internacional específica sobre el tema. La discusión teórica aborda cómo dichos factores pueden comprometer la agenda global de combate al problema. En cuanto a la metodología, la investigación tiene naturaleza aplicada, enfoque cualitativo y utiliza técnicas bibliográficas y documentales. Se concluye que es necesario establecer parámetros científicos comunes para la definición de materiales plásticos, adaptar el marco regulador internacional actual y crear un nuevo Acuerdo Global para el plástico, orientado hacia la gestión sostenible de los residuos plásticos y basado en el marco teórico-principiológico del Derecho Ambiental Internacional.

Mestre em Direito e desenvolvimento pela Universidade Federal do Ceará (1999). MBA em gestão de empresas FGV/MARPE (2005). Professor Titular da Universidade Federal do Ceará e do Centro Universitário 7 de Setembro - UNI7. Ministra as disciplinas "Direito da empresa I" (direito societário), "Ordem jurídica e economia na perspectiva dos direitos fundamentais" e "Meio ambiente, sustentabilidade e direitos fundamentais", respectivamente, na graduação e no Programa de Pós-graduação (Curso de Mestrado e Doutorado). Ex-coordenador do Programa de Pós-graduação em Direito da UFC. Tem experiência na área de Direito, com ênfase em direito comercial, direito econômico e ambiental, focando seus estudos e trabalhos principalmente nos seguintes temas: direito da empresa, direito da propriedade, efetivação dos direitos fundamentais, relações entre direito e economia, direito ambiental e biodiversidade.
