IDENTIFYING GAPS AND CHALLENGES IN THE (IN)DEFINITION OF A LEGAL ISSUE

Abstract

Marine pollution from plastic waste is a transcontinental and diffuse environmental problem. Despite its global scale, there are still significant legal gaps and challenges in understanding this phenomenon on a large scale. The aim of the article is to discern two identified gaps: the ambiguity of terminologies and the absence of specific international regulation on the subject. The theoretical discussion addresses how such factors can compromise the global agenda to combat the problem. Regarding methodology, the research is applied in nature, with a qualitative approach and using bibliographic and documentary techniques. The conclusion is that there is a need to establish common scientific parameters for the definition of plastic materials, to adapt the current international regulatory framework and to create a new Global Agreement for plastic, which should be oriented towards sustainable management of plastic waste and based on the theoretical and principled framework of International Environmental Law.

Mestre em Direito e desenvolvimento pela Universidade Federal do Ceará (1999). MBA em gestão de empresas FGV/MARPE (2005). Professor Titular da Universidade Federal do Ceará e do Centro Universitário 7 de Setembro - UNI7. Ministra as disciplinas "Direito da empresa I" (direito societário), "Ordem jurídica e economia na perspectiva dos direitos fundamentais" e "Meio ambiente, sustentabilidade e direitos fundamentais", respectivamente, na graduação e no Programa de Pós-graduação (Curso de Mestrado e Doutorado). Ex-coordenador do Programa de Pós-graduação em Direito da UFC.
