Justice, Punishment and Revenge in Arthur Schopenhauer's Philosophy

Abstract

This article aims to show, based on the critical reading and analysis of published writings and manuscripts of philosopher Arthur Schopenhauer – especially the texts related to his ethics - the contrasts and articulations between two types of justice suggested by the author in his work, namely, Temporal Justice (zeitliche Gerechtigkeit) and Eternal Justice (ewige Gerechtigkeit). To achieve this, we will analyze the concepts of law (Gesetz), punishment (Strafe) and revenge (Rache), which belong to temporal justice, and the concept of revenge as an arm of Eternal Justice (Arm der ewigen Gerechtigkeit). This objective has as its background the attempt to relate and articulate morality and legality, that is, the philosopher's metaphysics and his ethics.

Professor Adjunto na Universidade Federal do Acre (UFAC). Possui doutorado e mestrado na área de filosofia pela Universidade Estadual de Campinas (UNICAMP). Graduado em filosofia nas modalidades licenciatura e bacharelado pela Universidade Estadual de Campinas (UNICAMP). Realizou estágio no exterior no Centro Interdipartimentale di ricerca su Arthur Schopenhauer e la sua scuola da Università del Salento (2014), sob supervisão do presidente da seção italiana da Schopenhauer Gesellschaft, professor Dr. Domenico Fazio; realizou estágio no exterior na Schopenhauer-Forschungsstelle na JGU - Johannes Gutenberg-Universität Mainz, sob supervisão do presidente da Schopenhauer Gesellschaft e diretor da Schopenhauer-Forschungsstelle, professor Dr. Matthias Koßler. É membro do Grupo de Pesquisa Crítica e Modernidade (CriM); Integrante do GT-Schopenhauer da ANPOF; Membro da Comissão Editorial da Revista Voluntas - Revista Internacional de Filosofia (ISSN: 2179-3786); Editor de Layout da Revista Sofia (ISSN 2317-2339). Foi Professor Substituto na Universidade Federal do Espírito Santo (UFES) por quatro semestres letivos (2017-2018) e bolsista PNPD na mesma instituição (2018-2019). Tem como interesse atual a obra de Arthur Schopenhauer; a tradição jusnaturalista moderna; a tradição contratualista e seus expoentes; a origem dos direitos humanos e as relações existentes entre direito, democracia, poder, e paz.
