The rise of digital platforms has reshaped the dynamics of global competition, exposing structural weaknesses in traditional economic regulatory models. In Brazil, such transformations challenge the effectiveness of the current ex post approach adopted by the Administrative Council for Economic Defense (CADE), particularly in the face of information asymmetry, algorithmic opacity, and network effects that characterize digital markets. In this context, this article aims to critically analyze the institutional limits of Brazilian antitrust enforcement in the digital economy and to present a normative and institutional reconstruction proposal tailored to the national reality. The general objective is to understand the structural constraints of competition law enforcement in digital markets and, from this analysis, propose the creation of a Brazilian Digital Authority (ADB) and a Brazilian Code of Digital Markets (CBMD), inspired by the ex ante model of the European Union's Digital Markets Act (DMA). The specific objectives are: (i) to identify the main antitrust challenges posed by digital platforms; (ii) to evaluate the institutional and methodological capacity of CADE to address these challenges; (iii) to examine regulatory models adopted by jurisdictions such as the European Union, the United Kingdom, and Australia; and (iv) to develop a national proposal that is coherent, feasible, and technically grounded. The methodology is qualitative, based on bibliographic review, analysis of CADE’s decisions, and comparative international study. The findings suggest that overcoming regulatory inefficiency requires a structural reform of Brazil’s competition system, aimed at ensuring transparency, predictability, and effective protection of digital consumers.
