FONDO DE COMPENSACIÓN Y EVENTOS EXTREMOS: ASPECTOS INTRODUCTORIOS

El presente artículo se refiere a cuáles serían los valores y criterios de un fondo de compensación como herramienta relevante para el enfrentamiento de las pérdidas y daños derivados de eventos extremos asociados al clima. La investigación fue guiada por una metodología constructivista, complementada por los métodos auxiliares exploratorio y comparado. Las experiencias del derecho comparado en lo que se refiere a los fondos creados para la reparación de desastres antropogénicos son buenas fuentes de observación en relación a los puntos positivos y negativos a ser observados en el momento de la constitución de un fondo de compensación. Individualmente o incluso como parte de una estrategia mayor de capas de gestión de riesgo de desastre, desde que constituido ex ante, y por ley específica, el fondo es una tendencia mundial en la actualidad y puede ser una alternativa para Brasil. Numerosas características lo hacen más eficaz y relativamente menos complejo que otros instrumentos compensatorios como la responsabilidad civil y el seguro.
