The Displacement Incident of Jurisdiction and the definition of “serious violation of human rights”: a study on the legal precedents of the Superior Court of Justice

Abstract

The Constitutional Amendment 45/2004 modified the Article 109 of the Brazilian Constitution to introduce the Displacement Incident of Jurisdiction (IDC). Through this legal instrument, Superior Court of Justice (STJ) may transfer the legal authority from State Courts to Federal Courts in cases of (a) serious violation of human rights, (b) possibility of international accountability of Brazil and (c) the inability of the State judiciary system to investigate, prosecute and judge the case. Empirical research was carried out to investigate how STJ examines the definition of “serious violation of human rights”. Based on the Decision Analysis Method (MAD), 8 (eight) decisions were found. Qualitative analysis showed STJ did not base its decisions in coherent arguments, and little accuracy was found in the establishment of criteria.
