This articled verifies the potential conflicts that may arise between the new common European Union immigration policy and the Council of Europe, based on the “Directive on Return”. In 2008, the adoption of this Directive represented the culmination of the common immigration policy and requires minimum standards to identify, detain and expel undocumented immigrants. A concomitant process, but allocated in other international organization – the Council of Europe – made possible to submit the European community law to the European Convention of Human Rights. This institutional design suggests an unknown experience in international relations.
