Unseizability of quotas in credit cooperative societies

The social capital, consisting of the sum of the individual capital of each associate, subdivided into shares, is the instrument that entitles the cooperative to use the structure of the cooperative. In credit cooperative societies, social capital is of fundamental importance, since it guarantees the exercise of the activities inherent to the cooperative's corporate purpose, being indispensable for the financial health of the entity. It occurs that credit unions have been surprised by court orders that determinate the garnishment and avaluation of the shares that the cooperate has with the Cooperative, in the lawsuits that it appears as a debtor. Thus, it is tried to demonstrate that the legislator, aware of the relevance of the social capital in the cooperatives, inserted norms aiming the preservation of this one, as a way of preserving and encouraging the cooperativism. The shares of the share capital are not transferable to third parties outside the cooperative and are therefore not subject to attachment under Law No. 5,764 / 71, Civil Code, Complementary Law 130/09, Central Bank Regulations and Federal Constitution of 1988. The proper understanding of the matter is fundamental to provide greater legal certainty to cooperative societies, especially credit societies.Downloads
