O direito internacional e a colonização Palestina: breve análise sob as lentes das TWAIL

Este artigo analisa como o direito internacional tem funcionado como um instrumento ativo na perpetuação da colonização do território palestino. Trata-se de uma breve revisão da literatura e análise documental cujo objetivo é disponibilizar para a comunidade lusófona uma sistematização dos argumentos que mostram como a própria estrutura do direito internacional foi mobilizada para negar a soberania palestina e legitimar sua espoliação. A partir das lentes das Abordagens Terceiro Mundistas para o Direito Internacional (TWAIL), os resultados indicam que esses documentos foram ferramentas que legitimaram a partilha da terra sem consentimento, justificaram a ocupação militar e formalizaram um regime de dominação colonial sob a aparência de autogoverno. O estudo ilustra como o direito internacional tem funcionado, como projetado por suas origens coloniais, para subjugar o povo palestino.
